Where is Scott Peterson now and will he ever be released?

The spectacular case of Scott Peterson, who was convicted of murdering his wife and their unborn child over 20 years ago, is back in the spotlight. Where is he now?

The California man made headlines around Christmas 2002 when his wife, Laci Peterson, disappeared from their Modesto home. At the time of her disappearance, the 27-year-old expectant mother was eight months pregnant with her unborn son, Conner Peterson, sparking a large-scale search that attracted mainstream media attention.

Nearly four months later, mother and son were found dead in separate locations after washing up on San Francisco Bay. Scott Peterson was eventually arrested for double murder.

Scott Peterson's extramarital affair, financial problems and life insurance policies came into focus when a jury found him guilty of premeditated and suspected murder in November 2004. He was sentenced to death for the murders, which was later commuted to life in prison. He continues to argue his case to this day, having now enlisted the support of the Los Angeles Innocence Project.

Where is Scott Peterson now?

Scott Peterson has been living in Mule Creek State Prison since 2022, serving a life sentence without the possibility of parole, it is reported Oxygen.com. He had previously been incarcerated in California's only death row, the historic San Quentin State Prison (now San Quentin Rehabilitation Center), before Governor Gavin Newsom issued a decree moratorium on executions and granted Peterson and hundreds of other inmates a temporary reprieve.

Mule Creek is a men's state prison in Ione, California, about 40 miles east of Sacramento, and currently houses several well-known inmates. James Carson, one half of the serial killer duo known as Witch killers in California (as previously mentioned in Oxygens (Snapped: Killer Couples)is serving his time in Mule Creek. John Albert Gardner, convicted of the rape and murder of two teenagers and at the center of a 2022 Dateline: Secrets revealed Episode, is another notorious criminal under the same roof as Peterson.

Freeway Killer Patrick Wayne Kearney, one of Los Angeles' most notorious killers, is another murderer held at Mule Creek.

Previous Mule Creek inmates include I-5 Strangler Roger Kibbe, Manson Family cult member Charles “Tex” Watson, music producer Suge Knight and notorious 1990s criminal Lyle Menendez.

Peterson last appeared via Zoom on July 16, 2024, when a San Mateo County judge heard motions regarding the defendant's ongoing motion for a new trial, the San Francisco Bay newspaper reported. KRON TV. He appeared from a distance from Mule Creek.

Will Scott Peterson ever be released?

Scott Peterson is serving a life sentence without the possibility of parole, meaning there is no indication he will leave state prison in his lifetime, according to the California Department of Corrections and Rehabilitation.

However, this would change if his current appeal were successful.

On January 18, 2024, the Los Angeles Innocence Project took Peterson on as a client and filed motions “to request DNA testing and post-conviction evidence,” according to a statement from the Innocence Project. In court documents filed in San Mateo County Superior Court and obtained by The Associated Press, Attorneys suspected that Laci Peterson may have witnessed a break-in across the street from the couple's Modesto home on Christmas Eve 2002, the day the expectant mother disappeared.

The Los Angeles-based advocacy group theorized that Laci was kidnapped and murdered by the suspected burglars.

At a court hearing on Tuesday, July 16, 2024, the convicted husband’s defense attorneys said that phone calls from prison containing “critically important information” supported the burglar theory, according to KRON TV.

But the theory of the killer burglar was used in the trial against Scott by his defense and was rejected during an appeal. Authorities have adamantly insisted that the robbery likely took place on December 26, two days after Laci Peterson was last seen, according to a report by the Modesto Bee. The exact date of the robbery is unclear as the owners of the house were away from home from December 24 to 26.

The burglars themselves have denied any involvement in Laci Peterson’s death.

A judge must decide within 90 days whether to allow Scott Peterson's appeal.
