The three suspects accused of killing Oakland police Officer Tuan Le will go on trial, the Alameda County District Attorney's Office said Wednesday.

A preliminary hearing was held with suspects Sebron Russell, Mark Demetrious and Allen Starr Brown and, according to the prosecutor, the judge felt there was enough evidence to warrant a trial in the case.

“The court concluded that the prosecution presented sufficient evidence to establish that the defendants … 'knew or should have known' that Officer Tuan Le was a peace officer acting in the line of duty at the time of the murder,” the prosecutor said.

Several charges are brought against Sanders in the trial.

  • Murder with special allegations of personal and intentional discharge of a firearm causing grievous bodily harm
  • the murder of a peace officer who was carrying out his duties
  • Drive-by murder
  • Second degree burglary

Brown is charged with murder, intentional discharge of a firearm causing serious bodily harm, and second-degree burglary.

Russell is charged with murder, specifically murder in connection with three counts of second-degree burglary.

The three suspects are expected to appear in court on August 28.

A fourth suspect, Marquis Copper, was not “primarily involved in the murder,” according to the investigation, but faces three counts of second-degree burglary.
