“If the defendant’s conviction and sentence are upheld on appeal, he will likely remain in prison for decades and perhaps the rest of his life,” Judge Charlaine Olmedo he said on Jan. 24, noting that given his divorce, Masterson “has little reason to return to state prison to serve the remainder of his lengthy sentence should his appeal be unsuccessful.”

In June 2020, Masterson was initially charged with three counts of rape. He was released on $3.3 million bail at the time and eventually pleaded not guilty to all charges.

“From day one, I have denied the outrageous allegations against me. Law enforcement authorities investigated these allegations more than 15 years ago and determined that they were without merit,” he said Us in a 2020 statement. “I have never been charged with a crime, let alone convicted. In this country, you are presumed innocent until proven guilty. However, in the current climate, it seems that you are presumed guilty from the moment you are charged.”

Before the trial, Masterson tried unsuccessfully to have the charges dropped. The trial began in October 2022 and was declared a mistrial the following month due to a jury deadlock. The second trial began in April 2023, where Masterson was ultimately found guilty.

Phillips filed for divorce from Masterson in September 2023 following his conviction. Us confirmed the following month that the actor had given his estranged wife sole custody and residency rights for their daughter Fianna (9).

When it comes to Masterson’s pending appeal, it is unlikely that Masterson will win, attorney Neama Rahmani exclusively told Us in September 2023.

“It is very difficult to win on appeal and I do not expect Danny Masterson to win,” the lawyer explained. “And the reason is this: [Danny’s] Attorney said he didn't, but you generally can't appeal a jury verdict if it's a question of fact. [does the jury] believe Danny Masterson [or] “Do you believe the victims? And in this particular case, you believe two of the victims.”
