Brian Keely is on trial for the death of Samuel Sterling

Brian Keely, a former Michigan State Police trooper, has been charged with second-degree murder and manslaughter in connection with the death of Samuel Sterling in May.

KENT COUNTY, Michigan – The former Michigan State Police trooper accused of hitting and killing Samuel Sterling with his patrol car has learned he faces a murder trial.

After a federal judge declined to enter a ruling that would send the case to federal court, District Judge Amanda Sterkenburg made the decision to take the case to trial.

Brian Keely, a former Michigan State Police trooper, was charged in May with second-degree murder and involuntary manslaughter in the death of Samuel Sterling. He pleaded not guilty at his arraignment in June. Keely was granted bail of $250,000, meaning he could be released from custody without first posting bail or paying a deposit.

Judge Sterkenburg found there was sufficient probable cause to try Keely for both second-degree murder and manslaughter.

Keely's attorney waived the right to a plea bargain, and Keely's plea of ​​not guilty will stand for the upcoming trial in District Court.

In April, Samuel Sterling was approached by officers in Kentwood on outstanding felony warrants. Sterling fled from police, and a chase ensued, which ended with an unmarked MSP patrol car driven by Keely striking Sterling, who died in the hospital later that day.

MSP said Keely was suspended without pay and confirmed that Keely retired the day before his arraignment.

Keely was a member of the MSP for 26 years.
