Former Deputy Eddie Duran charged with manslaughter in connection with the shooting of pilot Roger Fortson in Florida

FORT WALTON BEACH, Fla. – The Florida Attorney General has filed charges against former Deputy Eddie Duran in the murder of U.S. Air Force Senior Airman Roger Fortson, who was killed in his own home.

Duran has been charged with manslaughter with a firearm, which carries a maximum sentence of 30 years. The court will issue an arrest warrant for Durant on Friday.

The deputy who shot Fortson during an altercation on May 3 was fired from the department in May, according to a statement from the sheriff's department obtained by ABC News.

Fortson, 23, was at his home in Fort Walton Beach, Florida, when Duran responded to a domestic disturbance call, according to the Okaloosa County Sheriff's Office. Fortson was alone in the apartment at the time.

In body camera footage released by the sheriff's office, Fortson is seen holding a gun in his right hand, arm extended down and the muzzle pointed at the ground as he opens the door to respond to the deputy, who twice announces he is from the sheriff's office. The footage, reviewed by ABC News, also shows Fortson raised his left hand with his palm visible and gesturing toward the deputy as he opened the door.

According to the footage, Duran shot Fortson within seconds of opening the door. Fortson died of his injuries.

The deputy said he saw Fortson armed with a gun and that Fortson took a step toward him and had an aggressive look in his eyes, according to an interview Duran conducted with the sheriff's office during the subsequent investigation.

Fortson's girlfriend, who asked not to be identified out of fear for her safety, told ABC affiliate WSB-TV in Atlanta in May that she and Fortson were on the phone discussing their plans for the weekend when the shooting occurred.

“We wish Mr. Fortson's family continued comfort and peace as the criminal case against the former deputy continues,” the Oklahoma County Sheriff's Office told ABC News in a statement. “We stand by our decision to fire Mr. Duran as the internal administrative investigation found that his use of force was objectively not appropriate.”

A search of the home found no one other than Fortson in the apartment, police said. In the body camera video, a woman, presumably a property manager, tells the officer that someone in the building informed her of the disturbance and she called the police.

In a statement to ABC News on Friday, Fortson's family said the charges were a “first step toward justice” in the case.

“Nothing can ever bring Roger back, and our fight is far from over, but we hope this arrest and these charges will lead to real justice for the Fortson family,” the statement said. “Let this serve as a reminder to all law enforcement officers everywhere that they have sworn a solemn oath to protect and defend, and that their actions have consequences, especially when they result in the loss of life.”

Prosecutors said they could only make very limited statements because the investigation is ongoing. No press conferences are currently planned.
