Tuan Le: Charges dropped against man for killing police officer

All charges have been dropped against one of the defendants in the case of an Oakland police officer who was killed during a botched break-in at a cannabis dispensary.

The defendant was one of four accused in connection with the killing of police officer Tuan Le in December, who died in the line of duty.

An Alameda County judge dismissed the murder charge against the third defendant two weeks ago and kept the burglary charge. However, the burglary charge was dropped on Wednesday.

Since no further charges are being filed against him, KTVU is keeping the man's name secret.

“His family looks forward to bringing him home soon,” his lawyer said.

The other defendants, Mark Sanders, Allen Brown and Sebron Russell, are charged with murder in connection with the shooting of Officer Le.

According to police, Le was shot on Dec. 29 while fighting off a burglary at a cannabis store on Oakland's Embarcadero. Le was working undercover in an unmarked vehicle when he was fatally struck by gunfire.

Sanders is the suspected gunman who fired the shots that killed Le, and Brown is the accused getaway driver. Russell was initially charged with burglary for his role in the pharmacy break-in, but later added murder charges.
