Charges filed against man accused of drugging and raping woman

A Hot Springs man accused of drugging and then raping a woman in 2020 after giving her a ride is now scheduled to be arraigned on Oct. 14 in Garland County District Court, where the case was filed directly last week.

Allen Lee Hosey Jr., 45, of a Laser Street address, has been held on $100,000 bail since his July 22 arrest. The rape charge carries a maximum sentence of life in prison. The case was filed in District Court on Sept. 10, and a news gag order restricting publicity ahead of the trial was issued the same day.

Hosey also faces a charge of third-degree domestic violence, a second offense punishable by up to six years in prison, pending his arrest on June 28, 2023. The charge stems from allegations that he inflicted injuries on his cousin at a family gathering 10 days earlier. Hosey was previously convicted of third-degree domestic violence on July 14, 2022, making the second offense a felony.

Hosey pleaded not guilty to the new assault charge on October 30, 2023. He is scheduled for a pretrial hearing in District Court on October 14, the same day as his rape arraignment.

According to court records, Hosey was arrested on May 1, 2013, on charges of rape and second-degree assault. However, after a two-day trial in District Court, he was acquitted of both charges on May 27, 2015.

According to the probable cause affidavit in the new rape charge, on October 17, 2020, Hot Springs police responded to a call from CHI St. Vincent Hot Springs regarding a sexual assault that had reportedly occurred earlier that day.

Investigators spoke with a 39-year-old woman who said she was walking in the 1200 block of Central Avenue around 7 a.m. that day when a man she knew as “Allen” drove by in a blue Dodge Charger and offered her a ride. She mentioned she knew the man from previous encounters but had never ridden with him.

She accepted the ride and asked to be taken to the EZ Mart, 760 Park Ave. Shortly after getting in the car, the woman noticed that her cell phone was dead and made a comment. Instead of continuing north to the EZ Mart, “Allen” headed south toward Laser Street.

When the woman protested, he told her, “You need to charge your phone,” and indicated she could do so at his home. The woman says “Allen” repeated this statement several times while she “continued to question” where they were going. Eventually, he parked in front of an apartment building in the 400 block of Laser and escorted the woman into an apartment.

Once inside, the woman plugged her phone into an outlet in the living room and sat down on a black futon. “Allen” asked her if she wanted coffee and she accepted. She says he then made her two cups of coffee in the kitchen, which was “out of her line of sight.” He returned with a “mug-style” cup of coffee, which she drank.

The woman said her next memory was waking up on the futon with her pants down and being raped by “Allen.” She described a “numbness” on the left side of her body and a “lightheaded feeling” and “disorientation.” She said she tried to get up to get to her phone, but he told her, “Leave it alone. Leave it charging.”

After an unknown amount of time, “Allen” sat up “as if he was done.” The woman checked her phone and saw that it was 1:30 p.m. She noted that she was unable to walk without assistance “due to the numbness described previously.” She said “Allen” then drove her to the EZ Mart at the park and dropped her off there.

The woman was later taken to CHI by family members and a sex crimes examination kit was picked up.

Officers checked the area of ​​the residence she had described in Laser and reportedly saw a blue Dodge Avenger registered to Hosey parked in front of it.

On December 13, 2023, the state crime lab reported a DNA CODIS hit matching male DNA found in the sex offender kit to DNA in Hosey's records. On July 19, a warrant was issued for Hosey's arrest on a rape charge and Hosey was taken into custody shortly before 12:30 p.m. on July 22 during a traffic stop on Virginia Street.
