Gary McMillian, Captain of the Lubbock Texas DPS, was arrested for indecent exposure to a child

A Lubbock State Police officer was behind bars on Thursday following an investigation by the Texas Rangers into indecent behavior with a child.

According to jail records, rangers arrested 54-year-old Gary Wayne McMillian at his west Lubbock home on Thursday. McMillian is a captain with the Texas Department of Public Safety based in Lubbock and was suspended after his arrest, the agency confirmed. He began his career with the DPS in 2003.

According to a criminal complaint filed in Randall County, McMillian is accused of inappropriately touching a family member in 2008 and 2012. However, the records do not indicate what prompted the investigation.

McMillian is charged with two counts of sexual abuse of a child, the DPS said. He remained in the Lubbock County Detention Center until late Thursday, with bail set at $50,000.

According to prison records, he was released on bail the next day.

His bail conditions include that he must not have any direct or other contact with the alleged victim, his relatives or anyone under the age of 17. He is also prohibited from coming within 60 metres of the alleged victim, his home, school or place of work.

As a condition of his bail, McMillian is also prohibited from possessing a firearm.
