Kenton man arrested after incident at Waffle House – Peak of Ohio

On Friday evening, police responded to a report of an argument at Waffle House involving a male customer who displayed a firearm.

Witnesses reported that the person got into a silver Dodge pickup truck and left the scene of the accident heading south on North Main Street.

Officers quickly located the vehicle and found that it exhibited erratic driving behavior, including swerving and fluctuating speed.

The truck made sudden movements and almost hit the curb before entering the parking lot of a gas station.

When they arrived, officers drew their weapons and ordered the male driver, later identified as Michael Atzbach, 43, of Kenton, to exit the vehicle.

Atzbach showed several signs of drunkenness, including bloodshot eyes and slurred speech.

A pistol and several unopened cans of alcohol were found on the passenger seat.

Atzbach was arrested for driving under the influence of alcohol and improper handling of a firearm in a motor vehicle, which is a felony charge due to his intoxicated state.

He refused to take a sobriety test and refused a chemical test at the police station.

Witnesses at the Waffle House reported that Atzbach was disrespectful and was asked to leave after displaying the gun and smiling at the customers.

The investigation is still ongoing and the firearm and the vehicle have been seized as evidence.
