Sean “Diddy” Combs is accused of drugging, raping and filming a woman in 2001: complaint

While embattled music mogul Sean “Diddy” Combs awaits trial in prison for sex crimes, he and his former bodyguard face new allegations of sexual assault in a new trial.

In a lawsuit and demand for a jury trial filed Tuesday, Sept. 24, in U.S. District Court for the Southern District of New York and obtained by PEOPLE, a woman named Thalia Graves alleges that Combs, 54, and his then-security chief Joseph Sherman raped her at the Bad Boy Records studio in New York City in the summer of 2001.

Graves claims the sexual assault was recorded on video and she has had suicidal thoughts ever since, the lawsuit states.

In the lawsuit, Graves states that she was 25 at the time and was dating one of Combs' co-workers. Combs “took advantage of this to entice her to meet with him and Sherman alone,” the lawsuit says.

“After they had successfully separated [her]Combs and Sherman gave her a drink “probably laced with a drug that eventually caused her to lose consciousness,” it is alleged.

When she woke up, the lawsuit continues, “she discovered that she was tied up and handcuffed.”

She claims she was raped “anally and vaginally,” the indictment states.

She said she never reported the incident to authorities because she was afraid of what Combs and Sherman would do to her, the complaint states.

She suffered from depression and anxiety for years, the lawsuit states.

Her fear grew immeasurably when she learned in November 2023 that Combs and Sherman had allegedly recorded the “gruesome rape,” according to the indictment.

She claims that Combs and Sherman “continued to show the rape video to others and/or sell it as pornography over the years and to this day.”

During the alleged rape, when she regained consciousness and screamed, Sherman slammed her “face into what appeared to be a pool table,” the indictment says.

During the alleged attack, she vomited on the table, but “Combs was undeterred,” the indictment states. “He wiped himself…” and continued to rape her, it says.

She says she considered suicide because of the alleged rape and the events that followed, the complaint states.

Combs is currently in jail after being arrested on September 16 and charged with sex trafficking, organized crime and transportation for the purpose of prostitution. He pleaded not guilty but was denied bail twice.

His lawyer Marc Agnifilo says his client is innocent.

“He will fight this with all his energy and all his power and the full confidence of his lawyers, and I expect a long fight with a good outcome for Mr. Combs,” Agnifilo said in court on September 17.

A hearing for Combs is scheduled for October 9 at 2 p.m.

Combs' attorney did not immediately respond to PEOPLE's request for comment. It is unclear whether Sherman has retained an attorney who can speak on his behalf.
