Pregnant woman dies in car accident, Milwaukee man found guilty in trial

A Milwaukee man was found guilty Wednesday in connection with a car crash that killed a pregnant woman.

Prosecutors charged 21-year-old Frank Mosley with first-degree reckless homicide, first-degree reckless homicide (unborn child), hit-and-run causing death, and fleeing from a police officer. The jury found him guilty on all four counts. Sentencing is scheduled for November.

Case details

The accident occurred on November 2, 2023, near 100th Street and Capitol. Milwaukee police said a Wauwatosa officer was pursuing a suspected stolen BMW that fled a traffic stop, but the pursuit was called off before the accident.

Surveillance video from a nearby gas station captured the accident. It showed the victim's vehicle entering the intersection before the fleeing driver sped into it. The video also showed the at-fault driver running across the parking lot.

The Milwaukee County Coroner's Office identified the victim as 32-year-old Erin Mogensen, who died at the scene. The coroner also said Mogenson was several weeks pregnant at the time of her death.

According to a criminal complaint, the Milwaukee Police Department's accident reconstruction unit downloaded data from the stolen vehicle's airbag control module. Prosecutors said the data showed the BMW was traveling 116 mph before the crash and slowed to 78 mph one second before the crash, “indicating heavy braking.” The speed limit on Capitol Drive at the crash scene is 35 mph.

Police found a Walmart receipt in the abandoned BMW. They went to the Walmart store that was listed on the receipt while also reviewing video. The complaint said the footage showed the BMW pulling into the parking lot. A man got out and walked into the store. In the close-up video, the man can be seen to have a “distinctive tattoo of a clock on his hand.”

On November 2, 2023, police went to the home where the BMW was originally stolen. The complaint states that when police “knocked on the door, they saw a man inside signaling to a woman inside the house.” The woman would not identify the man, prosecutors said, and officers later saw “a man's arm opening a window.” The officer shouted at the man to show his hands and the arm “abruptly retracted” and closed the window. Police then entered the home to prevent the man from escaping and found that Mosley had a “tattoo of a clock” on his hand.

When police looked into a smoking grill in the backyard of the house, they found charred and burned clothing and partially burned papers with the words “BMW Nord” written on them, according to the complaint. A key chain for the BMW was found in the house where Mosley was arrested.

When questioned by police, Mosley said he had had the car “about a week” before the accident, but someone stole it from him and he hadn't used it since. Mosley had “no explanation” for the BMW's presence outside the house where he was arrested.
