Driver charged with driving under the influence in crash that killed cyclist

Held on a $50,000 cash bond

A driver who struck and killed a bicyclist near Riverside was under the influence of alcohol at the time, authorities said.

Emily A. Davis, 25, of Kansas City, Platte County, is charged with DUI – death of another person. She is being held in the Platte County Jail on $50,000 cash bail only.

Her next court date is scheduled for October 1st.

As reported in last week's edition of The Landmark, the accident occurred at 5:30 a.m. Monday, Sept. 16, on NW Tullison, an outside road near Hwy. 9. Xavier M. Anderson, 25, of Kansas City was killed, according to a Missouri State Highway Patrol report. According to police, the rear of Anderson's bike was struck by a 2016 Chevrolet Cruze driven by Davis.

Anderson was taken to North Kansas City Hospital, where he died a few hours after the accident.

In court documents, Highway Patrol Sgt. J. Hall says when he arrived at the scene, he saw a badly damaged bicycle on the right side of the road near a utility pole. The pole itself had a scratch from the impact of the bike, says the police officer.

According to court documents, there was a red plastic part of a vehicle in the debris. The trooper said he was contacted by Riverside police that the vehicle involved was at a roundabout about a half-mile from the accident scene. Riverside police remained with the driver of the Cruze until another officer arrived.

Court documents show that Davis admitted to drinking alcohol and told officers she had been at the Argosy Casino most of the night and into the morning. Davis allegedly told officers that she estimated she had her first drink around 10 p.m. the night before and her last drink around 2 a.m

According to allegations in court documents, Davis exceeded a blood alcohol concentration of 0.164%. on a portable breath test. She later agreed to a chemical test of her breath, and authorities said that Davis gave a breath sample to the Riverside Police Department at 8:15 a.m. that showed her blood alcohol level was 0.139%.

The legal limit in Missouri is 0.08%.
