Colonie Area Weekly Police Blotter: Albany man arrested on felony charge of driving under the influence

COLONY – Colonie Police observed a vehicle stopped in the roadway near the intersection of Kenyon Drive and Vly Road at 5:49 a.m. Friday, Sept. 13, and determined the driver was reportedly intoxicated.

It wasn't his first time.

Esshodd Malloy, 39, of Albany reportedly had a DUI conviction 10 years ago, which led to officers charging him with felony DWI. The prior conviction automatically made the charge a felony.

Malloy also did not have a valid driver's license and was wanted on an outstanding warrant for a probation violation.

He was charged with DWI, warrant and aggravated unlicensed operation, all felonies. He was also ticketed for failure to maintain a single lane and a parking violation.

Malloy was taken to the Albany County Jail.

Criminal mischief

COLONY – A 36-year-old Rensselaer woman was involved in a physical altercation with employees at the IHOP on Wolf Road on Wednesday, September 11th.

During the incident, Emini Peters reportedly grabbed a victim by her hair, hit her on the head and broke a gold necklace.

Peters was charged with criminal mischief, a felony, and harassment, a violation. She later turned herself in to Colonie police and was ticketed to Colonie Municipal Court on Wednesday, September 25th.

Identity theft

COLONY – Carolyn Smith, 55, of Albany, turned herself in on Wednesday, Sept. 11, on an outstanding warrant related to an identity theft investigation.

Smith reportedly assumed another person's identity at Northway Mall on Monday, July 15.

She was charged with second-degree identity theft, a felony.

Smith was arraigned and arraigned in Colonie Town Court by Judge Andrew Sommers.

Grand theft and identity theft while on probation

LATHAM – Colonie Police responded to the Hudson Valley Credit Union on Loudon Road on Thursday, Sept. 12, for a report of fraudulent bank activity.

According to reports, after an investigation, officers arrested 43-year-old Ricardo Vargas of Albany and charged him with fourth-degree grand larceny and identity theft, both felonies. He was also charged with a probation violation, a misdemeanor.

Vargas was arraigned in Colonie Municipal Court.

COLONY – An Albany man who was cited by Colonie police Thursday, Sept. 12, for failing to appear in court while in custody on bail has been charged with two additional thefts.

Damian Perez, 33, was reportedly charged with petit larceny and criminal impersonation, both misdemeanors, in connection with an incident on Sunday, February 18, at the Target on Central Avenue. He was also charged with petit larceny stemming from an incident on Thursday, July 25, in Hannaford at Latham Farms.

Vehicle robbery

COLONY – Colonie Police responded to a domestic dispute on Schaffer Drive on Friday, Sept. 13 and arrested a Connecticut man following an investigation.

According to reports, at 10:26 p.m., Brandon Smith, 31, of Ledyard, Connecticut, was charged with felony assault with intent to inflict injury with a weapon, a felony, and reckless endangerment, as well as an act resulting in injury to a child. both offenses. The weapon was a motor vehicle.

Smith was booked into the Albany County Jail as a pretrial inmate. He was charged the next day.

Warrants everywhere

COLONY – A homeless man arrested in November 2023 for stealing $351.63 worth of merchandise from Market 32 ​​in Glenmont and Macy's in Colonie in 2022 and 2023 was booked on an outstanding warrant for failure to appear in the Schenectady County Jail taken into custody to appear in Bethlehem Municipal Court. He was also arrested by Colonie police on an outstanding warrant in Rotterdam on Friday, September 13th.

Michael Celic, 36, was processed on the Bethlehem warrant, arraigned by Judge Andrew Kirby and released under the supervision of probation. His return appearance is scheduled for Tuesday, October 1st.

Celic has not appeared in court in the past. He was charged with bail in April 2023 for failing to appear in Colonie Municipal Court to answer charges of burglary and theft stemming from a February 2023 incident. He had already been forced out of the store in 2022 due to other incidents.

In the Colonie case, Celic was transported by police to meet with officers from Rotterdam.

DWI and other charges

COLONY – Colonie Police responded to Margarita City on Central Avenue at 2:58 a.m. Sunday, Sept. 15, for a report of a fight and verbal altercation.

A 30-year-old Troy man was reportedly angry and extremely uncooperative. He became aggressive toward officers and struggled when they attempted to take him into custody.

Later, at the police station, he failed sobriety tests.

The man was charged with drunken driving, reckless endangerment and obstructing governmental administration, all misdemeanors. He was also charged with harassment, a violation.

The man was released on a Colonie Town Court appearance ticket on Monday, September 23rd.

Reckless endangerment and endangerment of children

COLONY – A 28-year-old Menands man turned himself in at 4:30 p.m. Monday, Sept. 16 and was charged in connection with an August incident at Aldi on Central Avenue.

Rynell Devine has reportedly been charged with reckless endangerment, a felony, and endangering the welfare of a child for the incident on Wednesday, August 7th.

He was arraigned by Colonie Town Judge Andrew Sommers.

Arrest warrants this week

Myaira Myrick, 21, of Albany, turned herself in Wednesday, Sept. 11, on a warrant for failing to appear in court in July.

Keirasten Catlin, 36, of Melrose, turned herself in Wednesday, Sept. 11, on a warrant for failing to appear in court in May.

Anthony Rodriquez, 23, of Schenectady, turned himself in Thursday, Sept. 12, on a warrant for failing to appear in court in July.

Jim Vu, 32, who is homeless, turned himself in on Thursday, Sept. 12, on four outstanding warrants for failing to appear in court in June.

Sean McManus, 28, of East Nassau, was taken into custody on Wolf Road Thursday, Sept. 12, on an outstanding warrant from the Schoharie County Sheriff's Office. He was transported to meet with deputies.

Laura Hamilton, 60, who is homeless, called Walgreens police to file a report and was wanted by Guilderland police. Guilderland police were on scene and picked her up.

Danielle Armstrong, 35, of Albany, was arrested on Saturday, Sept. 14, for petit theft at Walmart and also had an outstanding warrant for failure to appear in Colonie Town Court in July. She was taken to the Albany County Jail.

Raeshawn Lewis, 47, a homeless man, was arrested at 6:38 a.m. Monday, Sept. 16, at Cumberland Farms on Central Avenue after employees called police about trouble with a customer. Lewis fled on foot and was found to have an outstanding warrant out of Niskayuna. Officers from that department took Lewis into custody at the scene.

Tara Bradt, 35, of Rensselaer, was arrested at 4:45 a.m. Monday, September 16, at JT Maxies on Wolf Road on an outstanding warrant out of East Greenbush. She was handed over to the officers of this department on site.

Geneva Gundrum, 34, of Petersburg appeared in court on Monday, September 16, on an outstanding warrant for failure to appear.

Aaron Watson, 48, of Schenectady, was booked into the Schenectady County Jail on Monday, Sept. 16, on an outstanding warrant for failure to appear in Colonie Municipal Court. He was also charged May 19 with petit larceny at Target in Latham.
