VIDEO: Austin ISD assistant principal, students seen wrestling at high school

An Austin ISD parent says she plans to take legal action against the district.

Video taken on Sept. 18 shows a 10th grade student and his assistant principal wrestling in the bathroom at Navarro Early College High School.

The student says this incident happened during a bathroom break between classes.

“I was in the toilet and when I was in the stall I tried to close the door behind me. As I close the door I feel like someone is pushing it open and I turn around and it's the AP and he's telling me.” “Everyone has to leave the bathroom,” the student says.

The 10th grader says he tried to leave the restroom but was pushed back into the stall.

“Then I maneuvered my way out of the stall and he put his hand around my throat and after we argued as I was trying to get out of the toilet he grabbed me by my hoodie because it was tied around my neck “He grabbed me and then I started screaming and he grabbed me by the hair,” the student says.

He says another student started recording at that time.

Shortly after, another school official came in and broke up the altercation.

“They just suspended me and then said I could come back the next day,” the student said.

According to the student's mother, her son was suspended from school for smoking.

“No, I didn’t have a vape,” says the student.

“That wasn’t true, they never found him a vape, but that was their excuse,” the parent said.

The parent said she saw the video after her son returned to school following suspension.

“I was actually proud of him because, like I said, I wouldn't have been able to handle it like that. He did better than I thought he would or I would have done, and I was pissed that he got his hands on my son,” the parent says.

She says she informed school administrators that she wanted to press charges, and the district has scheduled a removal hearing for the student this week because of the altercation.

“When we left today he just refused, they didn't want to talk at all because we have a lawyer,” the parent said.

She says the school said an attorney also needed to be present and that the hearing needed to be postponed.

“I don't think they thought I would go to school, and I didn't want to be a concerned parent and just let it happen, like I'm sure a lot of parents do, but I did,” the parent said.

AISD released a statement regarding the incident:

“Today, October 2, the Austin ISD administration became aware of a video between a Navarro Early College High School assistant principal and a student that occurred last month. “The Austin ISD Talent Strategy team will conduct a thorough administrative investigation while Austin ISD police investigate the incident for any criminal conduct.”
