Suspect arrested in Denver shooting, Nebraska

Zachary Rice is accused of killing Marvin McCullough at a gang barbecue last March.

DENVER — A man wanted in connection with a shooting in Denver last March was arrested in Nebraska over the weekend.

Denver police said in an affidavit that 37-year-old Marvin McCullough was shot on March 30, 2024, at a barbecue organized by Crips gang members in Fuller Park near East 29th Avenue and Gilpin Street was organized.

McCullough was sitting in the driver's seat of a Mercury Cougar when he was shot, the affidavit states. Officers removed him from the car and performed cardiopulmonary resuscitation, but he later died in hospital. Police said he was shot five times on the right side of his body.

Based on tips provided by Metro Denver Crime Stoppers, investigators identified the suspect as 30-year-old Zachary Rice.

The affidavit said McCullough and Rice were both members of the same gang and had been feuding for a year. A witness told police that Rice admitted to shooting McCullough because it was “either me or him,” the document said.

Rice was arrested after a minor accident Sunday in Lincoln, Nebraska, where he is being held on a federal parole warrant. The affidavit states that when officers confronted him, he first gave them a false name before giving his real name and said he lied about having “warrants.” He fled when officers tried to arrest him, the affidavit says, but was taken into custody soon after.

The affidavit says Rice is charged with first-degree murder. It's not clear when he will be extradited to Colorado.
