ICE: NYC migrant arrested for rape at knifepoint and released at border

The Nicaraguan migrant accused of raping a woman near Coney Island in New York City this week was caught and released after illegally entering the United States.

Daniel Davon-Bonilla, 24, was first encountered in Eagle Pass, Texas, after entering the United States illegally on December 7, 2022, a spokesperson for New York's Enforcement and Removal Operations (ERO) confirmed to Fox News.

After Border Patrol encountered Davon-Bonilla, he was turned over to U.S. Immigration and Customs Enforcement (ICE) ERO and placed in a detention program with instructions to report to the ERO field office in Miami at a later date.

That “later date” was put on hold, and Davon-Bonilla continued his life in the United States, where he had repeated run-ins with police from April 2023 until his most recent encounter on Sunday in New York City.

Davon-Bonilla landed back on ICE's radar in April 2023 after he was arrested by the New York Police Department (NYPD) on suspicion of sex crimes.

On the same day, ERO New York City filed an immigration detention petition opposing his release at the NYPD Central Booking Office in Brooklyn, New York.

The Big Apple is a sanctuary city, meaning local law enforcement generally does not cooperate with ICE warrants, a requirement to notify the agency before releasing an immigrant from custody and to keep them in custody until ICE can take them into custody.

On September 6, 2023, ERO Miami terminated Pavon's Alternatives to Detention (ATD), which allows migrants to remain in the United States during their immigration proceedings, because he allegedly violated the terms of the program.

The ERO spokesperson confirmed that the Kings County Superior Court convicted Davon-Bonilla of assault on June 24, 2024.

Davon-Bonilla is then said to have attacked a 46-year-old woman on Sunday in the famous Brooklyn district of Coney Island and, together with an accomplice, raped her at knifepoint.

The New York Police Department arrested Davon-Bonilla for the alleged rape and filed an immigration detention petition with the New York Police Department's Central Booking Office in Brooklyn.

Following the alleged crime, NYPD Chief of Patrol John Chell expressed outrage over the city's sanctuary city status.

In an X-post following the incident, he argued that migrants like Davon-Bonilla were not coming to the United States in search of a better life, but to exploit urban residents.

“People from all over the world come to New York to find a better life – the American dream.” Posted by Chell. “However, a small portion have other intentions, including committing crimes and stealing from people in New York City. Daniel Davon-Bonilla is one of those offenders.”

“When will our sanctuary city laws be changed so we can notify federal authorities about the deportation of noncitizens convicted of violent crimes?” Chell asked. “If we don't take action, individuals like Daniel Davon-Bonilla will be able to continue to victimize women in our city.”

ICE and the U.S. Department of Homeland Security did not immediately respond to Fox News Digital's request for comment.
