The two brothers from the city are behind bars after police investigating a report of gunfire believed they were involved in the incident early Sunday morning, court documents show.

Jody Alan Colyer, 31, was arraigned Friday before Magistrate District Judge Benjamin F. Jones on charges of illegal possession of a firearm, two misdemeanor counts of conspiracy to commit reckless endangerment of another person, and one misdemeanor count each of possession of drug paraphernalia and possession of a controlled substance.

Unable to post $500,000 bail, he was taken to the Blair County Jail.

Robert Paul McCloskey Jr., 25, was charged Friday before Jones with three felony counts: prohibited possession of a weapon, evading arrest and possession with intent to distribute, along with conspiracy offenses – recklessly endangering another person and possession of drug paraphernalia.

He too was unable to raise the $500,000 bail and was sent to prison.

According to the affidavits in the case, Altoona police were called to a report of shots fired in the area of 17th Street and 8th Avenue around 1:41 a.m. on Sunday, August 11. Although no evidence was found at the scene, police continued their investigation and found surveillance video that showed six men walking near the scene when a white SUV drove by.

According to the police report, someone inside the SUV can be seen firing at least one shot from the vehicle. Immediately after that shot, one of the men in the pedestrian group fired at least two shots from a handgun at the SUV as the driver fled on 18th Street.

Police tracked the vehicle back to the Sheetz store at 1701 Seventh Avenue using video footage, and surveillance video from the store showed the brothers in the vehicle.

The SUV was tracked down through PennDOT and found to be registered to McCloskey, the report said.

On Thursday, investigators conducted surveillance in the 1300 block of Third Avenue and found the SUV parked in front of a residence.

McCloskey was seen leaving and re-entering the house with his brother.

When Colyer was discovered at the corner of 13th Street and Third Avenue, police arrested him.

According to court documents, McCloskey was taken into custody after a three-hour standoff at the Third Avenue apartment.

In an interview, Colyer said the group of men harassed him and his brother, and when they left Sheetz, his brother followed the group and shot them with a gun, police reported.

A search warrant was executed at the residence for drugs and firearms. The search yielded 7 ounces of marijuana, several smoking devices, a large amount of packaging material, a Century Arms AK rifle, a Taurus .38 Special revolver and a G-Force semi-automatic shotgun, the affidavit states.

The report states that the brothers are convicted felons and are therefore not allowed to own firearms.

Their preliminary hearings are scheduled for August 28 before Jones.

Investigations into the identity of the other shooter involved in the incident are ongoing, police said.
