Car accidents in Michigan

Mt. Morris Twp., MI – Accident with injuries at the intersection of W Pierson Rd and N Linden RdDealing with the aftermath of a car accident can be very difficult. Each year, tens of thousands of car accidents occur in Michigan that result in serious injuries. If you were involved in an accident, you may be able to take legal action against the person responsible. Working with a car accident lawyer can increase your chances of proving that the other party was at fault. To win a negligence lawsuit, you must prove five key elements:

  • Duty of care: You must prove that the person who caused the accident had a legal responsibility to act carefully and not cause you harm. This means that they were expected to follow the rules of the road and drive safely.
  • Breach of duty: You must prove that the person failed to meet that responsibility. For example, if the person was driving too fast, missed a red light, or was distracted, they did not act as a reasonable person would have done.
  • Causality in fact: You must prove that the person's irresponsible behavior was a direct cause of your injuries. This means that you must prove that your injuries were a result of the person's behavior.
  • Immediate cause: You must prove that the injuries were a foreseeable consequence of the other person's negligence. In other words, you must prove that the type of injury you suffered was a probable consequence of the other person's negligent conduct.
  • Damage: Finally, you must prove that you actually suffered damages as a result of the accident. This may include medical bills, lost wages, and other costs associated with the injury. You may also be able to recover damages for pain and suffering or emotional distress.
