Destiny Payton charged with contempt of court in divorce proceedings + receives suspended sentence

Destiny Payton’s ongoing legal battle against her ex-husband continues.

An Alabama court has provided an update on Love and Marriage: Huntsville star Destiny Payton's divorce and legal woes with ex-husband La'Berrick Williams. Last week, a judge ruled against Destiny in her ongoing divorce battle with La'Berrick. As previously reported, La'Berrick reopened the divorce late last year and accused Destiny of not complying with the divorce decree.

In various court documents, he claimed that Destiny made it very difficult to sell their shared home after the divorce. He also said Destiny failed to refinance the home in her name and did not help pay the mortgage on the property and certain medical bills for their son. La'Berrick accused Destiny of missing or being late for multiple pick-up and drop-off times as part of their joint custody of their son and of speaking frantically about him in interviews. Order documents obtained by Urban Belle note that the court modified the order in 2023, two years after the original divorce became final. Under the modification, either party could hold the other in contempt of court if they do not comply with the divorce order.

The judge agrees with La'Berrick that Destiny violated several provisions of the divorce decree, including giving interviews in which she discussed the marriage, even though she had agreed not to do so during the divorce. Therefore, the judge convicted Destiny on nine counts of contempt of court. He imposed a 45-day suspended sentence for two years. The judge also imposed nine 5-day sentences for each count, to be served consecutively.

To avoid going to jail, Destiny must comply with all aspects of the recent divorce decree, including not speaking out of despair about La'Berrick and adhering to the co-parenting schedule. She must also pay La'Berrick $12,779.13 in attorney fees, which includes fees she was supposed to pay La'Berrick in 2023 under the decree modifications.

$1,170.77 for her child's unpaid medical bills.

$639.83 for their share of the homeowners association fees and assessments.

$4,093.64 for unpaid mortgage payments.

According to the order, La'Berrick must repay all of the money within 30 days to avoid serving her sentence. This case also does not end the open criminal case against Destiny. In that case, La'Berrick accused Destiny of falsifying his name on documents in order to obtain a utility guarantee from the local power company.
