Suspect in TJ Maxx case remains in prison

QUINCY (WGEM) — The man charged in connection with a shooting at TJ Maxx in Quincy remains in jail pending trial.

According to the Herald-Whig, Alan C. Pacheco, 21, of Quincy, appeared in court Wednesday for a release hearing.

Police said they were called to the mall at 2:28 p.m., where they found a 22-year-old man with gunshot wounds.

Pacheco was arrested Saturday afternoon after returning to the crime scene to give a statement to police.

Pacheco's attorney Ryan Schuenke argued that the two men Pacheco shot were actually the attackers and that Pacheco acted in self-defense.

Schünke said that given the circumstances, it was unfair that only Pacheco was behind bars.

First Assistant District Attorney Todd Eyler said the incident is under review and charges will likely be filed against the other two men.

Schuenke called for Pacheco to be released so he can work and continue his studies at John Wood Community College. He also said Pacheco is willing to surrender his FOID card.

The Herald-Whig reported that Judge Holly Henze ruled that Pacheco should remain in the Adams County Jail, saying that since the other men were not in custody, they could find Pacheco and pose a threat to him and the public.

A status hearing is scheduled for October 9 and the case will be placed on the trial docket in November.
