Man killed in Daytona Beach driving aggression incident punched shooter in face and had knife

A man, Daytona Beach police say, shot another man Sunday in an incident of driving aggression at a McDonald's near Margaritaville, testified to police, saying the victim stabbed him with a knife as he sat in his car, according to a report.

Rustam Gallyamov, 40, a Destin resident, told police that after the altercation began in the drive-thru lane of the McDonald's at 2709 LPGA Blvd., he drove off and pulled into a parking lot to allow the victim, Brian Collins, to pass, police said.

Gallyamov said that after Collins drove past him, he backed out of the parking lot and pulled behind Collins, but Collins suddenly stopped and blocked his path, a report said.

Collins got out of his car, approached Gallyamov, who was sitting in his vehicle, and struck him through the open driver's window, police said.

Gallyamov told police that Collins had a knife and thought he was going to use it. Fearing for his life, he shot Collins, police said. Gallyamov then called 911 to report the shooting, police said.

Daytona Beach police said they reviewed surveillance video from the McDonald's and concluded the incident was portrayed exactly as Gallyamov described it.

When officers arrived at the scene of the shooting at 8:06 p.m., they found Collins lying on the ground with a gunshot wound. A witness performed CPR on him.

Police said they found the firearm used by Gallyamov. Eight witnesses were interviewed. The shooting remains under investigation.
