Justin Timberlake is expected to plead guilty to driving under the influence

According to a source familiar with the case, Justin Timberlake will plead guilty to one count of driving under the influence of alcohol as part of an agreement with the Suffolk County District Attorney's Office in New York; prosecutors have agreed to drop drunken driving charges against the singer.

The agreement calls for a yet-to-be-determined fine, but the judge could impose other penalties and must still approve the agreement at a hearing scheduled for Friday morning, at which Timberlake is expected to be present.

Before the agreement, Timberlake pleaded not guilty in August to a misdemeanor charge of drunken driving. If convicted, he would have faced a maximum of one year in prison and a $2,500 fine.

In New York, according to the state Department of Motor Vehicles, a blood alcohol content of over .05 is “legally valid evidence that you are impaired,” while “a BAC of .08 or more is evidence of intoxication.”

Timberlake was arrested in Sag Harbor in June after police said he left the bar at the American Hotel shortly after midnight, drove his 2025 BMW down Main Street and failed to stop at a stop sign and stay in his lane. Police also said Timberlake failed a breathalyzer test and refused to take a breathalyzer test several times, saying, “No, I'm not taking a chemical test.”

At a hearing in late July, Timberlake's lawyer denied that the artist was drunk and argued that he should not have been arrested.

Timberlake performed his Forget Tomorrow Tour this summer. His next performance is scheduled for September 28 in New Jersey.
