Trial postponed against man accused of killing two toddlers in Eagle Mountain

PROVINCE — Kent Cody Barlow's trial was scheduled to begin Monday, but on Friday, September 13, the Utah Supreme Court granted Barlow's attorney's request to remove him from the case involving a fatal car crash in Eagle Mountain.

Attorney Benjamin Aldana had previously asked the 4th District Court to remove him from the case. When the court denied that request, Aldana appealed to the Utah Supreme Court.

In May, two children died in a car crash when a vehicle went out of control and crashed into a pen where the children were playing. On Tuesday, a judge ruled that statements made by suspect Kent Cody Barlow cannot be kept confidential. (Utah County Sheriff's Office)

According to KSL.com, Aldana had previously attempted to delay the trial. In June, he took an extended leave of absence due to his father's terminal illness, arguing that the defense “could not adequately prepare for trial without additional time.”

Aldana appealed to the Utah Supreme Court, asking that he be granted “time off from his profession to properly mourn the unexpected death of his father.”

KSL.com also reported that Aldana cited a Utah state statute before the Supreme Court that requires an attorney to withdraw if his “mental capacity impairs representation” and that he was not feeling his usual self.

Barlow is accused of driving a vehicle that sped into Cedar Valley Stables at more than 100 miles per hour, hitting and killing two three-year-old boys who were playing near the stables.

He is accused of two counts of first-degree murder. According to KSL.com, there is no new trial date.
