Preliminary hearing against Rochester man for premeditated murder

ROCHESTER, Minn. (KTTC) – A Rochester man accused of first-degree murder appeared before a judge for a pretrial hearing Friday.

Mustafa Bush, who was 39 at the time of the 2022 murder, was charged with the murder of 41-year-old Kimberly Ann Robinson of Eyota. Robinson's body was later discovered in a ditch. Robinson was reportedly an acquaintance of Bush.

The defense filed numerous motions on Friday, including on jury selection and the questions that will be asked on the jury selection questionnaire. The defense also argued that any crime scene or autopsy photos should be black and white, not color, because color photos could “incite” the jury and potentially induce bias.

The judge did not rule on any motions today and said he would consider them at a later date. The trial is scheduled to begin on October 21.

Bush was originally charged with first-degree murder in Robinson's death.

In January, a grand jury indicted Bush on first-degree murder charges.

Bush had a criminal record before Robinson's murder. In 2006, he was convicted of second-degree premeditated murder in the death of 25-year-old Cory Richardson.

Bush and two others were convicted of Richardson's murder.
