Horace Brown Jr. was charged with attempted first-degree murder and violating a domestic violence restraining order through possession of a firearm or ammunition.

The victim, who suffered a gunshot wound to the abdomen, was taken to Sacred Heart Hospital in critical condition after the incident was reported around 1:50 p.m. in the 2800 block of Highway 95, just north of Quinette Road.

Shortly after the incident, the Escambia County Sheriff's Office said Brown claimed he shot his brother to intervene in an argument in which the brother allegedly hit their mother.

According to a recently released police report, Brown was in his recording studio, which was located in a shed in the backyard of the family's trailer. He told officers that his brother had a history of mental health issues that led to violent outbursts. He told officers that he heard his mother and brother arguing loudly in the trailer.

“He ran into the apartment and said that his mother was being attacked and that he went 'boom boom boom', which meant he had shot (the victim),” the ECSO report states. Brown refused to speak further unless an attorney was present.”

Investigators arrived at Sacred Heart Hospital but were unable to speak to the victim because he was undergoing surgery.

The mother told officers that both brothers were her children and all lived together in the apartment. She said the victim became angry and she told him to go outside to cool off, the report states. She then went outside to the porch, where he punched her in the face. After she was allegedly punched in the face, they went back to the kitchen of the apartment.

According to investigators, she said Brown came in through the back door a few minutes later, pulled out a gun and pointed it at the victim. The mother yelled at Brown several times not to shoot his brother before a shot was fired.

The mother stated that Brown “should not have done this and at no time was she in fear for her life due to the attack on (the victim),” the report states. She stated that “the initial assault between her and (the victim) was a separate incident than when Brown Jr. shot (the victim) as there was no continuation of the initial altercation.”

In 2005, Brown was granted a domestic violence restraining order that prohibited him from ever possessing firearms or ammunition.”

Investigators found two projectiles and a cartridge case in the kitchen of the house.

Brown has pleaded not guilty through his public defender and is due back in court next month.
