On 23 January 2019, the police station had arrested Maloud Manjeet Singh, 44, of Mandiani under the NDPS Act in the case. According to the prosecution, ASI Gurjant Singh was at the T-Point bus stand in Raurian along with other policemen that day. At around 6.15 pm, he received a tip-off that the accused was on his way from Kup village to Ramgarh Sardara and was carrying large quantities of drugs.
Based on the tip-off, the police went to the crime scene and arrested the accused. The tablets were found in a cloth bag that the accused was carrying.
During the trial, the accused pleaded false imputation. The accused's lawyer argued that the recovery took place in a public place and no independent witness was involved in the case. The court found the argument baseless and ruled that it was a settled law that mere non-participation of an independent witness is not fatal to the prosecution. “As people from the public generally shy away from taking part in the investigation. In such circumstances, the statements of official witnesses have to be verified and if they are found to be trustworthy, action can be taken,” the court said. TNN
