Trial of hit-and-run defendant in which a pregnant woman died

MILWAUKEE – The trial has begun for a man accused of a hit-and-run that killed a pregnant woman.

Frank Mosley, 21, appeared in court in Milwaukee on Tuesday to face a number of felony charges, including first-degree manslaughter.

The Milwaukee artist is accused of the high-speed crash that killed 32-year-old Erin Mogensen in 2023. Mogensen had just celebrated her wedding anniversary.

According to Milwaukee police, Wauwatosa police attempted to stop a BMW with no license plate, but the driver sped away. The pursuit was called off for safety reasons. The BMW was later involved in an accident at the corner of 100th and Capitol in Milwaukee.

Mosley ran away. Police later found him and were able to arrest him using a receipt found in the stolen BMW.

Most of the testimony Tuesday came from several Milwaukee police officers who detailed the results of their investigation. One officer explained that the speed of the stolen BMW Mosley was driving was recorded at 111 mph three seconds before the crash and 62 mph when it collided with Mogensen's vehicle.

“The driver brakes with such force that the anti-lock brakes kick in… And the roads were dry at the time, so the driver brakes with maximum force,” testified Milwaukee police Officer Richard Schnier.

Mogensen's family was in court; many of them wore purple in remembrance and remained true to the 32-year-old's legacy.

Since Mogensen's death, her family has lobbied doggedly for change regarding reckless driving. They paved the way for a new law that would impose a mandatory minimum sentence for offenders who flee from police and cause serious injury or death. They are also part of a new initiative to monitor sentencing of reckless drivers.

The state concluded its investigation on Tuesday afternoon.

The trial will continue on Wednesday morning. It is unclear whether Mosley will testify as a witness.
