David Lee Codd, who is accused of threatening to kill people at Barwise Middle School, was back in jail Friday on charges related to the purchase of an assault rifle.

According to an original affidavit, a Barwise student contacted Codd on Sept. 19 about issues the student was having. Codd then called the school and spoke with the administrator who had been caring for the student.

According to allegations in the affidavit, during the course of the conversation, Codd said, “I'm going to come up there and kill everyone.”

The administrator told the principal that students and staff had been threatened. The police were called to the scene.

The student who contacted Codd also told authorities that Codd was possibly a gang member and “had a lot of weapons,” the affidavit said.

Codd, who lists an address on Norman Street in Wichita Falls, posted $50,000 bail and was released the following day.

According to a motion to declare bail insufficient filed late Thursday by the Wichita Falls Independent School District Police Department, Codd ordered the rifle from Cash and More Pawnshop on Jacksboro Highway the day he was released.

The application stated that the weapon should be delivered on Saturday.

The motion says the purchase of the weapon would “pose an extremely serious threat to the safety of the community, particularly the students, faculty and staff of Barwise Middle School, and the community at large.”

People accused of crimes are presumed innocent unless convicted in a court of law.
