Man killed by police ID

Investigators have identified the man who was shot by police Tuesday morning at a home on Route 4 in Northwood. Officials with the New Hampshire Attorney General's Office said around 5:17 a.m. a Northwood police officer went to the home to file a report of domestic violence between Malcolm Burns, 34, and his father. The officer and Burns then got into a physical altercation. During this time, the officer shot Burns, who was pronounced dead at the scene. “And when the Northwood police officer responded to that call, a physical altercation occurred between him and Mr. Malcolm Burns,” said Assistant Attorney General Nicholas Chong Yen. Sources told News 9 Investigates that Burns was reportedly armed when he was shot. Investigators said the officer was injured in the altercation, but officials said the injuries were not life-threatening. Officials with the New Hampshire Attorney General's Office said that at approximately 5:17 a.m., a Northwood police officer contacted the home for a report of domestic violence between Malcolm Burns, 34, and his father.

The officer and Burns then got into a physical altercation. During this time, the officer shot Burns, who was pronounced dead at the scene.

“And when the Northwood police officer responded to that call, a physical altercation occurred between him and Mr. Malcolm Burns,” said Assistant Attorney General Nicholas Chong Yen.

Sources told News 9 Investigates that Burns was reportedly armed when he was shot.

Witness Cody Webster said he rented a few rooms at 534 First New Hampshire Turnpike and was home with his wife and 9-year-old daughter at the time.

Webster said he and his wife woke up to the sound of a person being thrown against the wall. He said he believes the incident involved a man trying to protect his son's girlfriend from his son.

“Around quarter past five we heard a lot of screaming and banging and a lot of shouting, a lot of shouting and threats, and then we opened the door to see what was going on,” Webster said. “We asked one of the homeowners if he was OK. He said no. And then his son told us to mind our own business, to which we said OK and closed our door.”

He said his wife called 911.

Webster said that after police arrived, he could hear them telling Burns to surrender.

An autopsy for Burns is scheduled for Wednesday.

The name of the officer who shot the man is being withheld pending the completion of a formal interview, investigators said.

“At this point, we must continue to go through the crime scene, conduct physical evidence as well as an interview with the officer as per regular protocol,” Chong Yen said.

Homeland police responded on Tuesday saying it was related to a standoff in July. Burns was arrested following this incident.
