New evidence in the murder case is being examined

“We are here to tell you that we have a moral and ethical obligation to consider what is presented to us and make a decision,” said LA District Attorney Javier Gascon

Over 30 years New evidence in the case of Erik and Lyle Menendez will be reevaluated following their conviction for murdering their parents, Los Angeles District Attorney Javier Gascon announced in a news conference Thursday.

According to the Los Angeles Times, Gascon said his office will review newly surfaced evidence that the brothers' father molested them. The decision could lead to a resentencing, although Gascon said the office has not yet made a decision.

“We are not prepared to believe or disbelieve this information,” Gascón said Just. “But we are here to tell you that we have a moral and ethical obligation to consider what is presented to us and make a decision.”

The Menendez brothers were convicted of murder in the 1990s in a trial that roiled the country both because of the high stakes of the Menendez family's money and the violence of the killings, with much of the trial taking place on television.

The review comes amid renewed interest in the infamous case in the hit Netflix series Monster: The story of Lyle and Erik Menendezcreated by Ryan Murphy. The Menendez family heavily criticized Murphy and the show last week, calling it “a phobic, gross, anachronistic, serial episodic nightmare that is not only full of falsehoods and outright untruths, but also ignores recent exculpatory revelations.”

“Our family has fallen victim to this grotesque, shocking drama,” wrote Joan VanderMolen, the brothers’ aunt. “Murphy claims he spent years researching the case, but in the end he relied on the exposed Dominick Dunne, the pro-prosecutor, to justify his smears against us and never spoke to us.”

On trend

Through his wife, Eric Menendez called the show “vile and appalling.”

Murphy defended the series, responding to Menendez's claim and stating, “I know he hasn't seen the show.”
