Man charged with attempting to hit a Dayton school

Swatting is when someone makes false reports to law enforcement about potentially dangerous situations in order to harass someone else.

According to an affidavit filed in Dayton Municipal Court, Murphy allegedly called 911 around 9:20 a.m. on Sept. 24 to report that a five-year-old Emerson Academy student had a gun in his backpack.

The five-year-old is Murphy's son, over whom he does not have custody, the affidavit states. During the call, Murphy gave his name as that of the boy's maternal uncle.

Police determined the boy did not have a weapon.

At 10:37 a.m., Murphy called 911 again and was upset that the school had not been evacuated, court documents said. According to court documents, he was arrested in possession of the cellphone he used to make the 911 call.

The affidavit states that this is not the first time Murphy has claimed his son has a gun [the 5-year-old’s] Residence.”

Murphy was granted a conditional guarantee of recognition of his own. He has been placed on electronic house arrest and is prohibited from calling 911 or Emerson Academy from any phone.

He is scheduled to appear on the arraignment Oct. 17.
