(CBS DETROIT) – A 59-year-old Commerce Township man is charged in connection with a crash that killed a 40-year-old motorcyclist.

The Oakland County Sheriff's Office said the man turned himself in Friday and was charged with a moving violation resulting in death.

The accident occurred the night of June 16 on Wixom Road near Stratford Villa Way in Commerce Township.

The man was driving a Toyota Sienna on Wixom Road and approaching Stratford Villa Way when he struck a stopped motorcycle driven by 40-year-old Joshua Moomaw, according to the sheriff's office. The motorcyclist was waiting to turn onto Stratford Villa Way.

Authorities say the 59-year-old did not observe the stopped motorcycle and that alcohol and drugs were not factors in the accident.

Moomaw died of his injuries on June 24. His 41-year-old wife, who was also on the motorcycle, was taken to hospital for her injuries and later released. The sheriff's office said neither person was wearing a helmet.

A preliminary hearing is scheduled for October 16th. If convicted, the man could face up to a year in prison and a $2,000 fine.

Last week, a 21-year-old man died afterward drunk, he crashed his motorcycle in Commerce Township. The autopsy revealed that Lucas Horsch had a blood alcohol level of 0.12% at the time of the accident. Under Michigan law, a driver is considered intoxicated with a blood alcohol content of 0.08% or more.
