White woman who ‘falsely accused’ two black men of rape after pool threesome breaks her silence and sues THEM after her case was thrown out

A white woman whose rape claim against two black men was thrown out by a grand jury is sticking to her story in a horrifying new lawsuit.

Amanda Zawieruszynski, 40, accused her neighbor John Marks, 41, of raping her on November 8 along with his friend, policeman Freddie Douglas, 43.

The mother-of-three claimed the pair forced her to have a threesome in the pool at Marks’ house in in Manvel, just outside Houston.

Marks and Douglas were arrested last December but the aggravated rape and kidnapping charges were dismissed by a grand jury in May after footage from Marks’ home security system exonerated them.

Douglas was fired from his job as a detective, and had to sell his family home in a ‘fire sale’ to pay legal fees. Both are suing Manvel police and Zawieruszynski.

But Zawieruszynski insisted her rape claims were true, and filed her own lawsuit on August 26 demanding more than $1 million in damages.

The lawsuit claimed she ‘believed she would die that night’ and was held captive and raped numerous times, each more violent than the last.

Zawieruszynski also gave a harrowing account of what she claimed happened, which she said ‘disfigured’ her and caused internal and external injuries that required ‘surgical intervention’ and ongoing treatment.

‘I felt like I was drowning in a sea of shame, fear, and confusion,’ she said in a statement obtained by DailyMail.com.

‘No one prepares you for the aftermath of such a violation, especially when one of the perpetrators is a member of law enforcement who is supposed to protect you.’

Zawieruszynski moved to Manvel last February after breaking up with her husband Michael Zawieruszynski early last year.

She explained she was a single mother and had a casual sexual relationship with Marks, after he bought the newly built five-bedroom, three-and-a-half-bathroom house across the street on Palermo Way for $629,950 last May.

They broke it off not long before the alleged rape, but ‘maintained a positive relationship as friends’, she said.

Douglas, who described Marks as his ‘longtime best friend’, explained in his lawsuit that he met Zawieruszynski for the first time that day when she arrived with a tray of cupcakes she baked for his birthday. 

Marks and Douglas later went to a Houston Rockets basketball game, and texted with Zawieruszynski to confirm they would have a late-night swim in Marks’ pool.

She said this was ‘not out of the ordinary given our relationship… however, this time was different’.

‘This time, I was held captive. I was force-fed alcohol, my clothing was forcibly removed, my body was battered, and I was raped repeatedly throughout the night,’ she said.

‘Let me be clear, absolutely nothing consensual would ever require surgical intervention and ongoing medical treatments to heal the internal and external physical damage that was done to me that night. 

‘The questioning of my experience is not just insulting, it is retraumatizing.’

Zawieruszynski said since the pair were acquitted and filed lawsuits, a ‘misleading and harmful racial narrative’ emerged, and shifted the blame to her.

‘[This] has nothing to do with the fact that I was brutally raped,’ she said.

‘Some of the scars I carry are invisible, while others remain in plain sight and affect every aspect of my life. Speaking out about my experience is one of the hardest and most important things I’ve ever done.’

Zawieruszynski’s lawsuit, obtained by DailyMail.com, laid out her version of events that night in graphic detail, some of it too horrifying to publish, from the moment she walked in the door.

All seemed well until the gathering moved outside to the pool and the men started swimming, and she joined them in the water.

Douglas ‘started making inappropriate remarks about his wife for him to be having sex with another woman and his wife finding out about him cheating again and spoke about divorce’, the lawsuit claimed.

Marks suggested they all swim naked, but Zawieruszynski said she was not comfortable with this.

The lawsuit claimed Marks tried to take the strap off her bathing suit and she told him to stop and tried to leave the pool.

‘Suddenly and without warning, Marks grabbed her and became aggressive… and demanded that she “take that f**king thing off”, referring to her one-piece,’ the lawsuit claimed.

‘Marks began forcing her legs open to get off the one-piece bathing suit as he grabbed the strap off the tops of her bathing suit. 

‘Zawieruszynski fought Marks, but Marks overpowered her and forced her head underwater. At one point, [she] was slammed against the pool.’

The lawsuit claimed once he pulled her bathing suit off, Marks told Douglas to grab it from her and the pair playing ‘keep away’ with it until Marks threw it out his yard.

‘After forcibly removing her clothes, they refused to allow her to leave the pool and forced liquor down her throat, to the point she could not even hold her head up. They refused to allow her to put her clothes on,’ the lawsuit continued.

The lawsuit claimed the rapes began after this, both in the pool and inside the house.

‘[Zawieruszynski] got sick from the alcohol, emotional distress, and physical assault despite her attempts to pour drinks in the water and not drink any more alcohol that was being forced upon her, and despite her attempts to resist,’ it claimed.

The lawsuit claimed she was unable to overpower them and could only yell for them to stop while both Marks and Douglas raped her over and over and blocked her escape.

Once they were finished raping her outside, Marks demanded she go inside and shower, the lawsuit claimed.

Afterwards, the lawsuit claimed Marks raped her at least three more times that night, ‘getting more violent even as she fought to try and keep him off’.

The lawsuit claimed every time she put her clothes back on and tried to leave, he said ‘where do you think you’re going?’ ripped her clothes off, and raped her again – despite her kicking him and begging to be let go.

Zawieruszynski was only able to escape from the house the next day, the lawsuit claimed.

The lawsuit detailed the traumatic injures and psychological damage Zawieruszynski suffered as a result of the alleged rape.

‘She has permanent physical scaring and continued for months with vaginal bleeding and damage internally, in addition to extensive bruising and marking across her body,’ it read.

‘She has required surgical intervention from the repeated sexual assault and rape. 

‘She has further required extensive physical and mental treatment as a result of [the] defendants’ actions.’

Zawieruszynski said in her account that police gathered more than 300 pieces of evidence corroborating her story, after she reported it.

They included one of the men’s failed polygraph, one of their statements, a rape kit completed on the day, medical exams that discovered tearing and internal bleeding, and images of severe bruising and bodily harm.

‘Yet the assistant district attorney failed to present this information to the grand jury and the men who assaulted me were never indicted,’ she said.,

‘This was a strategic mishandling of the case that prioritized power and optics over facts.’

Zawieruszynski blamed this for the grand jury dismissing the case, and claimed she was harassed by Marks and Douglas after she reported them.

‘No one prepares you for what to do when your rapists show up to your house, follow your car, and contact you repeatedly resulting in the state government placing you and your children under protective care,’ she said.

‘My family and I have had to relocate for safety purposes under the Texas Rape Shield law after my rapists would not leave me alone, and I am now living in isolation in my own community. 

‘Despite being considered a protected victim by the state, I have never had the opportunity to recover fully emotionally or physically, or for my children to receive closure knowing their mom is safe.’

Zawieruszynski said she feared the rest of her life would be defined by what allegedly happened to her, ‘and so far, those fears have been true’.

While the criminal case was ongoing she couldn’t be identified, but when Marks and Douglas filed their lawsuits, her name was broadcast to the world.

Strong statements from their lawyers and the language in the lawsuits painted her as a racist white woman who inexplicably accused two black men of rape.

Zawieruszynski said this led to her being ‘repeatedly confronted in my community about this narrative deeming me a racist instead of a survivor’.

She said this forced her to speak publicly about her claims and sue Marks and Douglas so everyone would know the truth.

‘I’ve chosen to reclaim my narrative, to speak my truth, and to demand justice, not just for myself, but for all survivors – because allowing a false narrative to exist that diminishes a rape under the guise of racism is offensive and an injustice,’ she said.

Douglas’ lawyer Michael Kerenksy said the video evidence would again exonerate his client, and accused Zawieruszynski of fleeing her home to avoid being served with the lawsuit.

‘We are aware of her alleged “rape kit”. Presumably, the grand jury that no-billed this case was also made aware of the rape kit,’ he said in a statement.

‘The findings of that exam are equally consistent with having consensual sex with two men, one of them all night long.’

Kerenksy submitted a brief answer to the lawsuit on September 17, denying all the allegations.
